What is TPD?

TPD stands for Tobacco Products Directive (Tobacco Products Directive 2014/14/EU), an EU initiative designed to regulate the production, sale, advertising, and packaging of tobacco products to enhance health protection and awareness. The directive governs all aspects of tobacco products, including their ingredients, how they are manufactured, and the way they are marketed.

TPD applies not only to traditional tobacco products like cigarettes and cigars but also to vaping devices and e-liquids. It ensures that ingredients are tested before being sold to consumers, and that packaging displays the relevant information. Additionally, TPD dictates how these products are taxed and where they can be used.

Why Does TPD Apply to Vaping?

Although vaping products don’t contain tobacco leaves, they are classified as tobacco products because the nicotine in most e-liquids is extracted from tobacco plants. Even with the advent of synthetic nicotine, any product containing nicotine still falls under the scope of TPD regulations.

When Did TPD Come Into Effect?

The TPD was established in May 2014 and became law on May 20, 2016. Following this, any non-compliant stock had to be sold or removed from shelves. This marked a shift in the availability and labeling of vaping products, ensuring compliance with the new regulations.

How Does TPD Affect Vaping?

TPD regulations primarily influence the size, composition, and labeling of vaping products. While much remains the same for consumers, the directive introduced several key changes:

  • E-liquid Capacity: E-cigarette tanks, including pod systems and disposables, can only hold a maximum of 2ml of e-liquid.
  • Bottle Size: Nicotine-containing e-liquids are limited to 10ml bottles.
  • Nicotine Strength: The highest permissible nicotine strength is 20mg/ml, significantly lower than the 50mg/ml allowed in some countries like the US.
  • Child Safety: All nicotine-containing e-liquids must be packaged in child-resistant bottles.
  • Ingredient Restrictions: Products cannot contain substances like caffeine or taurine.
  • Nicotine Warnings: Packaging must clearly indicate that the product contains nicotine and include a warning that nicotine is an addictive substance.
  • Approval by MHRA: All e-cigarettes and e-liquids must be submitted to the Medicines and Healthcare Products Regulatory Agency (MHRA) for approval before they can be sold.
